Mid Ulster District Council Court of Appeal Success

The Court of Appeal has today (20 September 2018) allowed Mid Ulster District Council’s appeal in respect of the calculation of Rates Support Grant by the Department for Communities (formally Department of the Environment) in 2015.

The Council’s case had its basis in the view that the formula which is used to calculate Rates Support Grant was incorrectly applied by the Department, resulting in the Council’s wealth being overstated and the grant payable to the Council being less than it should have received.

The Court of Appeal agreed with Mid Ulster District Council that the Department had misapplied the formula and allowed the appeal.

Chair of Mid Ulster District Council, Councillor Se├ín McPeake said: “The Council is very pleased with this decision which has potentially a significant and positive impact on the level of grant which Mid Ulster will receive, and will now be discussing with the Department how it plans to give effect to the Court of Appeal’s judgement.”
